In 1991, Nicholas Montalto graduated Magna Cum Laude from the University of Connecticut with a degree in Accounting and Taxation. He went on to serve as auditor and tax practitioner with the Certified Public Accounting firm of Mazars & Co., in New York City.


Inspired by his grandfather, a New York City Judge and Magistrate, and father, an Estate Planning attorney and CPA, Mr. Montalto later received his Juris Doctorate from Whittier Law School, where he was a scholarship recipient.


In 1995, Mr. Montalto founded his own law firm, and is now a principal with the firm of Sanders & Montalto, LLP. Mr. Montalto’s emphasis and expertise is in the areas of Estate Planning, Trust and Probate Law, and Civil Litigation, including Trust Litigation, Personal Injury & Wrongful Death. Mr. Montalto has successfully applied his litigation and negotiation skills in obtaining millions of dollars in settlements, judgments, and verdicts on behalf of his litigation clients.


Mr. Montalto brings an extensive background in tax law to the firm’s Estate Planning practice, differentiating him from many other Estate Planning attorneys. Additionally, because Mr. Montalto not only drafts trusts and Estate Plans, but litigates them in Court, he is provided a unique perspective in understanding the shortcomings of many trusts, and how to perfect them whether it be in the area of tax avoidance, creditor protection, or simply protecting the client’s wishes from being successfully challenged later in court.


Mr. Montalto has gained a reputation in the community as one of the few Estate Planners capable of handling complex or high net worth Estate Planning, having been retained by many local Estate Planning firms and CPAs to assist their clients in drafting complex irrevocable trusts, including Dynasty Trusts, Grantor Retained Trusts (GRATS/GRUTS), Intentionally Defective Grantor Trusts (IDGTS), Qualified Personal Residence Trusts (QPRTS), Irrevocable Life Insurance Trusts (ILITS), Family Limited Partnership Trusts (FLPS), Spousal Lifetime Access Trusts (SLATS), and Charitable Remainder/Lead Trusts (CRATS/CRUTS).


In addition to representing individuals and non-profit organizations, Mr. Montalto represents many small to large corporations, including insurance companies, banks, law firms, and entertainment companies with the same passion and dedication.


Mr. Montalto is admitted to practice before all courts in the State of California, in addition to the U.S. Federal District Court for the Central District of California.


In 1999, Mr. Montalto was admitted and qualified as an Attorney and Counselor of the United States Supreme Court. He is also a member of the California and American Bar Associations.
